This agreement (as amended from time to time, the “Agreement”) is between Evergen Pty Limited (Evergen) and you.
The Agreement governs participation in the Evergen customer referral offer administered by Evergen (the “Program”). By installing an Evergen system offered to you as part of the Program, you indicate your acceptance of this Agreement and agree to all of its terms and conditions as of the date of that action (“Effective Date”).
You agree that Evergen may offer differing terms and conditions to other participants of the Program.
1. Participation requirements
1.1 In order to participate in the Program, you must:
1.2 Be at least 18 years of age.
1.3 Participate in the free electricity audit as part of the site visit.
1.4 Provide your most recent electricity bill to us.
1.5 A full system installation is required to be eligible for a bill refund for one year.
1.6 Installation of additional PV and a battery enables eligibility for a bill refund for one year.
1.7 Installation of a standard 6kW PV or greater sized system designed specifically for electricity consumption reduction is required for eligibility of a bill refund for one year. A smaller system will enable eligibility for a bill refund for one year.
1.8 Have purchased and booked the installation of an Evergen system offered to you as part of the Program, on or before 31 December 2019.
1.9 If your electricity usage increases by more than 10% of the year preceeding the offer, the eligibility for a bill refund will be for one year.
2. Bill refund amounts
2.1 In consideration of your participation in the Program, Evergen will provide you with bill refund payments up to the full amount your electricity bill for one year, but not exceeding $1,000.00.
3. Timing of bill refund payments
3.1 Bill refund payments will be provided in arrears at the end of the 12 month period, in accordance with participation requirements.
3.2 Bill refund amounts will begin to be calculated from the first day of the billing period following Full Economic Operation of your Evergen system.
3.3 Full Economic Operation is determined to occur following the installation of your system and payment to you of a solar feed in tariff by your electricity retailer.
4. How to claim your bill refund payments
4.1 Following the end of the 12 month period, send a copy of your electricity bill/s to Evergen at firstname.lastname@example.org within 30 days of the end of that period.
4.2 Evergen will make your bill refund payment to your nominated bank account within 30 days from the date you provide your bill/s to Evergen and your claim is approved.
5. Term and Termination
5.1 This offer is valid only for Evergen systems purchased on or before 31 December 2019.
5.2 This agreement terminates on 15th January 2022
6.1 Evergen may modify or amend this Agreement, and any part of the Program at any time for any reason. Evergen shall provide you with written notice of any such modifications or amendments.
7. Personal Information
8.1 Each party acknowledges that in entering into this Agreement it has not relied on any representations or warranties from or by the other party except as expressly provided by the written terms of this Agreement.
9.1 You may not assign or transfer any rights under this Agreement without Evergen’s prior written consent.
10.1 All notices from Evergen shall be delivered to you using the then-current contact information associated with your account. All notices from you shall be delivered to Evergen at email@example.com
11. Governing Law
11.1 This deed is covered by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of its courts and courts of appeal from them.
12. Entire Agreement
12.1 This document constitutes the entire agreement of the parties about the subject matter and supersede all previous agreements, understandings and negotiations on that subject matter.
