Terms and Conditions
This agreement (as amended from time to time, the “Agreement”) is between Evergen Pty Limited (Evergen) and you.
The Agreement governs participation in the Evergen customer referral offer administered by Evergen (the “Program”). By installing an Evergen system offered to you as part of the Program, you indicate your acceptance of this Agreement and agree to all of its terms and conditions as of the date of that action (“Effective Date”).
You agree that Evergen may offer differing terms and conditions to other participants of the Program.
1.Participation requirements. In order to participate in the Program, you must:
1.1 Be at least 18 years of age.
1.2 Provide your most recent electricity bill to us.
1.3 Installation of a 10.3kWh AlphaESS battery system and a 5.6kW Jinko 330w Solar or greater sized system designed specifically for electricity consumption reduction is required for eligibility.
1.4 Have purchased the system and had the system installed, on or before the 1st December 2020.
1.5 Allow Evergen to dispatch your battery system and control your energy consumption for any events which have been initiated by Energex. Control of your energy consumption will be limited to any additional installed control systems as installed as part of this program. More information on the Energex pilot can be found here.
2. An offer can be made to extend the program and Evergen will provide terms and details as and if any extension is offered, you will have the opportunity to not extend.
3. You must own the property on which the system is installed and this must be in one of the following Chapel Hill 4069, North Lakes 4509, Wakerley 4154 and Springfield Lakes 4300. No businesses are eligible for the pilot. The pilot is only open to residential customers.
4. Terms and Termination
4.1 This offer is valid only for Evergen systems purchased before and installed before the 1st December 2020.
4.2 This agreement terminates on the 30th April 2021.
5. Modifications & Inclusions
5.1 Evergen may modify or amend this Agreement, and any part of the Program at any time for any reason. Evergen shall provide you with written notice of any such modifications or amendments.
5.2 "Free 5.6kW solar installed when you buy a battery" offer refers to 5.6kW of Jinko 330w solar panels, 10.3 kwh Alpha battery and standard installation. Additional installation fees may apply depending on your specific installation requirements.
6. Personal Information
6.1 Any information that Evergen collects about you will be dealt with in accordance with Evergen’s Privacy Policy, which can be found at http://www.evergen.com.au/privacy-policy and can be shared with Energy Queensland as part of the program for the period leading up to and inclusive of the program period.
7. Disclaimer
7.1 Each party acknowledges that in entering into this Agreement it has not relied on any representations or warranties from or by the other party except as expressly provided by the written terms of this Agreement.
8. Assignment
8.1 You may not assign or transfer any rights under this Agreement without Evergen’s prior written consent.
9. Notices
9.1 All notices from Evergen shall be delivered to you using the then-current contact information associated with your account. All notices from you shall be delivered to Evergen at redeem@evergen.com.au
10. Governing Law
10.1 This deed is covered by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of its courts and courts of appeal from them.
11. Entire Agreement
11.1 This document constitutes the entire agreement of the parties about the subject matter and supersede all previous agreements, understandings and negotiations on that subject matter.
